State calling rules

Mississippi telemarketing rules for life insurance agents.

Mississippi allows telephone solicitations only between 8 a.m. and 8 p.m. Central Standard Time and never on Sunday, and these rules apply even to callers who are otherwise exempt. A recorded voice message through an automated dialing system is allowed only to tell an existing customer about a new product or service. Licensed agents are exempt from Attorney General registration, except for Medicare Advantage and Medicare supplement calls. Checked against the statute on November 3, 2026. Do Mississippi's rules apply to licensed insurance agents?

Partly. Licensed agents soliciting insurance are exempt from Attorney General registration (§ 77-3-711(d)), but the hours, Sunday ban, identification and recorded-voice rules in § 77-3-723 apply to authorized solicitations, including calls by exempt solicitors. The exemption does not cover Medicare Advantage calls, which § 77-3-707(4) bars unless the consumer called first (HB 1350 (2024)).

Can an AI voice call leads in Mississippi?

Carefully. Mississippi limits automated dialing systems that use a recorded voice message to calls to existing customers about a new product or service (§ 77-3-723(2)). The statute says nothing about written consent as an alternative. Whether an AI-generated voice counts as a “recorded voice message” under this section is a question for counsel. Until you have an answer, consider calling Mississippi leads with a person.

How do Polca's calling limits compare with Mississippi's rules?

On every call, AI and human, Polca calls only between 9 a.m. and 7 p.m. in the lead's local time (checked against the lead's state and area code), never dials on Sundays, checks the agency's opt-out list at dial time, adds opt-outs it detects on calls, caps attempts per lead, and gives the agency a kill switch. Agencies can tighten these limits (narrower hours, lower caps) but cannot loosen them.

  • Hours and Sundays: Polca's 9 a.m. to 7 p.m. local window and no-Sunday rule are inside Mississippi's 8 a.m. to 8 p.m. Central Standard Time.
  • AI voice: Polca leaves the decision to your agency. You can keep Ava off Mississippi lists and call them with a person on the power dialer.
  • Medicare Advantage: Polca's limits don't cover this ban. Keep Medicare Advantage leads out of outbound lists for Mississippi unless the person called first.

These limits do not cover every state rule. Polca's Calling & AI Voice policy says state holiday or emergency restrictions and state rules stricter than these limits are the agency's responsibility. Polca does not scrub lists against the National Do Not Call Registry or any state list, and its own registrations do not cover the agency. Your agency has to check the rules of every state it calls.

What should an agency calling Mississippi leads do?

  • Get counsel's view on § 77-3-723(2) before an AI voice calls Mississippi leads.
  • Give the caller's name, agency and purpose at the start of every call.
  • Keep Medicare Advantage outbound solicitations out of Mississippi unless the consumer called first.
  • Scrub the federal registry, which is Mississippi's list.
