State calling rules

Louisiana telemarketing rules for life insurance agents.

Louisiana's do-not-call program is run by the Public Service Commission (LPSC): a telephonic solicitor registers and pays a fee to get one list that includes Louisiana numbers on the National Do Not Call Registry. LPSC rules bar calls on Sundays and legal holidays and outside 8 a.m. to 8 p.m. Monday to Saturday. We found no insurance-agent exemption. Checked against the statute on November 3, 2026. Federal rules apply on top of these: the TCPA, the FCC's rules in 47 CFR § 64.1200 and the FTC's Telemarketing Sales Rule. See Can AI call life insurance leads?

Do Louisiana's rules apply to licensed insurance agents?

Yes, as far as we could find. The do-not-call statute's exclusions and the LPSC general order's exceptions contain no insurance-agent exemption (R.S. 45:844.14; R-29617). The LPSC says complying with the national registry does not replace Louisiana registration (LPSC FAQ).

Can an AI voice call leads in Louisiana?

Louisiana's automatic dialing statute (R.S. 45:810 to 45:817) regulates equipment that plays recorded messages: hours, consent given for a particular call through a live operator or a consent feature, a permit and a bond (R.S. 45:812; 45:813). Whether a conversational AI agent is that kind of equipment is a question for counsel. Federal law still requires prior express written consent for an artificial-voice sales call (FCC 24-17).

The LPSC rules also bar calls to cell phones unless made with the recipient's prior express consent (R-29617 § V(A)(12)(b)).

How do Polca's calling limits compare with Louisiana's rules?

On every call, AI and human, Polca calls only between 9 a.m. and 7 p.m. in the lead's local time (checked against the lead's state and area code), never dials on Sundays, checks the agency's opt-out list at dial time, adds opt-outs it detects on calls, caps attempts per lead, and gives the agency a kill switch. Agencies can tighten these limits (narrower hours, lower caps) but cannot loosen them.

  • Hours and Sundays: Polca's 9 a.m. to 7 p.m. window and no-Sunday rule are inside Louisiana's limits.
  • Legal holidays and declared emergencies: not blocked by Polca. Pause Louisiana lists yourself on those days.
  • Louisiana's list: not scrubbed by Polca. Register with the LPSC, get the list and suppress it.

These limits do not cover every state rule. Polca's Calling & AI Voice policy says state holiday or emergency restrictions and state rules stricter than these limits are the agency's responsibility. Polca does not scrub lists against the National Do Not Call Registry or any state list, and its own registrations do not cover the agency. Your agency has to check the rules of every state it calls.

What should an agency calling Louisiana leads do?

  • Register with the LPSC for the calendar year and suppress the Louisiana list.
  • Pause Louisiana calls on Sundays, legal holidays and during declared emergencies.
  • Give the caller's name, phone number and agency right after the person answers.
  • Ask counsel whether R.S. 45:810 to 45:817 apply to AI calls before Ava calls Louisiana leads.
